The website footpass.com is hosted by Cloudflare, Inc. (101 Townsend Street, San Francisco, CA 94107, United States - European network).

The application footpass.app and the API api.footpass.app are hosted by Amazon Web Services EMEA SARL (38 avenue John F. Kennedy, L-1855 Luxembourg), on data centres located in Switzerland.

The Link System and Digital Authorisations of FOOTPASS® constitute proprietary innovations protected under Swiss law and applicable international conventions.

Access and Use

Access to footpass.com is free. Use of FOOTPASS® services is subject to the Terms of Service available at footpass.com/cgu.

Users under the age of 18 must hold an active Legal Representative Link on the platform. The terms are set out in the Terms of Service and in §13 below.

Limitation of Liability

FOOTPASS SA shall not be liable for indirect damages arising from the use of the website or application. This limitation does not apply in cases of wilful misconduct or gross negligence, in accordance with applicable Swiss law.

Amendments

Governing Law and Jurisdiction

This Legal Notice is governed by Swiss law. In the event of a dispute, the Handelsgericht (Commercial Court) of the Canton of Zurich has jurisdiction for disputes between professionals, and the ordinary courts of the Canton of Zurich for all other disputes.

Consumers residing in the European Union retain the benefit of the mandatory protections of their national law. The European online dispute resolution platform (ODR) is accessible at ec.europa.eu/consumers/odr.

Legal Surveillance (LSCPT)
